1. Acceptance of Terms

By accessing, creating an account with, or utilizing the services provided by SubScraper ("SubScraper," "we," "our," or "us"), including our website at subscraper.dev, our REST API endpoints, client software development kits (SDKs), and Model Context Protocol (MCP) tools (collectively, the "Service"), you ("Customer," "User," or "you") agree to be legally bound by these Terms and Conditions ("Terms").

If you are entering into these Terms on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind such organization to these Terms. If you do not agree to these Terms, you must immediately cease all access to and use of the Service.

2. Description of Service & Independent Provider Status

SubScraper provides developer infrastructure designed to retrieve, format, and deliver publicly available data from online discussion forums into structured JSON formats.

3. Public Data Scope & User Responsibilities

The Service strictly accesses and delivers publicly accessible information—data that is visible to any standard web browser without requiring user credentials, private membership, or bypassing password barriers. SubScraper does not access private chat messages, locked subreddits, or unreleased draft content.

You acknowledge and agree that:

• You are solely responsible for ensuring that your collection, storage, and processing of public forum data complies with all applicable local, national, and international laws, including data protection regulations such as the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA).
• You will respect the intellectual property rights and privacy rights of authors whose public comments and submissions you process through the Service.
• You will not use public data retrieved via SubScraper to de-anonymize private individuals, construct illegal surveillance registries, or facilitate unlawful targeted harassment.

4. Accounts, API Keys & Security

To utilize our endpoints, you must generate an API key by creating an account. You agree to provide accurate, current information during registration and to maintain the security of your credentials.

• Confidentiality: Your API key acts as your private authentication credential. You are entirely responsible for all activity, request consumption, and charges incurred under your API key.
• Prohibition on Sharing: You may not publicly expose, resell, distribute, or share your API keys in publicly accessible client-side code repositories, frontends, or unauthorized third-party platforms.
• Revocation: If you suspect that your API key has been compromised, you must immediately regenerate or revoke it through the SubScraper Dashboard.

5. Acceptable Use Policy (AUP)

You agree not to use the Service to:

• Conduct denial-of-service (DoS) attacks, flood requests beyond established rate limits, or intentionally degrade the performance and stability of our infrastructure.
• Attempt to reverse-engineer, decompile, or extract the underlying proprietary algorithms, scrapers, or routing systems of SubScraper.
• Bypass, disable, or tamper with security or rate-limiting features, authentication checks, or request quotas.
• Facilitate unsolicited marketing campaigns, spamming, bulk automated messaging, or deceptive online influence activities.
• Violate any applicable state, federal, or international statute, ordinance, or administrative regulation.

Violation of this Acceptable Use Policy may result in immediate suspension or permanent termination of your account and API keys without prior notice or refund.

6. Pricing, Credits & Billing

SubScraper operates on a combination of prepaid credit packages and monthly subscription tiers:

• Hobby Tier ($0/mo): Includes 30 complimentary requests for developer evaluation. No credit card required.
• Prepaid Credit Packs (Starter & Growth): Purchases of one-time credit packages (e.g., Starter $1.99 / 1,000 requests, Growth $17.90 / 10,000 requests) are non-expiring. Credits remain in your account until consumed.
• Monthly Pro Tier ($149/mo): Grants 100,000 requests per monthly billing cycle. Unused monthly requests do not roll over between cycles.

All billing and payments are processed securely by our authorized merchant of record, Dodo Payments. You authorize SubScraper and Dodo Payments to bill your chosen payment method for all orders placed.

Refund Policy: Due to the digital and consumable nature of API infrastructure, all sales are final once requests have been successfully dispatched. If you experience a verified platform outage or billing error, please submit a request to support@subscraper.dev within fourteen (14) days of the transaction.

7. Rate Limits & Service Availability

To maintain high quality of service for all users, requests are subject to rate limiting (e.g., 10 requests per second by default). Requests exceeding rate limits or total available balance will return standard HTTP 429 status codes.

While we strive for 99.9% uptime, SubScraper does not warrant that the Service will be completely uninterrupted, error-free, or resilient to upstream third-party platform alterations. Maintenance, network congestion, or upstream structural changes may temporarily impact data retrieval times.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SUBSCRAPER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS, (II) THE DATA RETRIEVED WILL BE TIMELY, ACCURATE, COMPLETE, OR CONTINUOUSLY ACCESSIBLE, OR (III) THE DATA RETRIEVAL WILL NEVER BE DISRUPTED BY THIRD-PARTY PLATFORM POLICIES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

IN NO EVENT SHALL SUBSCRAPER, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA LOSS, LOSS OF GOODWILL, WORK STOPPAGE, OR SYSTEM MALFUNCTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.

SUBSCRAPER'S TOTAL AGGREGATE LIABILITY UNDER THESE TERMS FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO SUBSCRAPER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless SubScraper, its officers, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with: (i) your access to or use of the Service; (ii) your violation of these Terms; or (iii) your infringement or violation of any rights of another party, including intellectual property, privacy, or third-party platform conditions.

11. Modifications to Terms & Services

We reserve the right to revise or modify these Terms at any time. When modifications occur, we will update the "Last updated" date at the top of this document. Continued use of our Service after any such changes constitutes your acceptance of the new Terms.
